Sedimentation is the product of uncontrolled erosion and is a significant pollutant to our lakes, streams, and drain systems. Construction is one of the major causes of erosion in Michigan, therefore steps have been taken to control the amount of sediment that enters our waters of the State through Part 91 of the Natural Resources and Environmental Protection Act (NREPA). According to Part 91, a soil erosion permit is required for any earth change that disturbs one or more acres of land or is within 500 feet of any waters of the State.
For sites with an earth change of five or more acres and a discharge of stormwater to waters of the State, the landowner of easement holder is also required to apply for Notice of Coverage (NOC) through EGLE's MiEnviro portal.
