Writs of Restitution
A Sheriff's Deputy serves Writs of Restitution (court-ordered evictions). Fees for the service of a Writ of Restitution are $40.00 plus mileage (currently $0.55 per mile). Writs are served Monday through Thursday between the hours of 8:00 a.m. and 4:00 p.m. Writs received on Friday will not be processed until the following Monday. A standard 48-hour notice to vacate will be attached to the Writ when served, unless otherwise specified at the time of receipt. Notification will be made by phone from the Sheriff's Civil Process Division of date and time served. Follow-up on vacancy of tenant(s) is the responsibility of the owner of the premises as is the physical removal of the tenants' personal belongings. If the tenant does not vacate and an officer is requested as a standby while the eviction process takes place, one will be scheduled. Arrangements for an officer to standby can be made with the Civil Process Division at (989) 895-4071.
